Anybody 79 years old who grew up with the BOIL THE WATER on top of the stove coffee pots like she did as a young person then tries to say I did not think it could be this hot is way out there.

Also sqeezing it with your knees! :gaah:

Come on! Tell me a 79 year old has this amount of control holding a cup of coffee between her knees as to not crush it flat the minute the top is taken off! As a designer I can tell you much of these cups strength comes from the top being in place. To remove the lid while between your knees is insane! Why was the cup maker not sued for making cups you can crush between your knees!

Also the reflex to grab it tighter with your knees if the cup moves is almost a 100% way to assure you will crush the cup flat as the lid came off.

Yes she did get hurt, and yes it was sad. But to say a beverage that has been made forever by pouring BOILING WATER over ground coffee beans was served too hot! COME ON!

185 degrees does seem hot, that is until you put in 35 degree milk, then it goes way down. So I don't know about all the black coffee drinkers out there, but I still like my coffee hot after I put in the cream. Starting with really hot coffee is the only way I end up with hot coffee after the cream is put in.

:agree: with MM. Lack of own judgment bottom line, unless she was suffering from dimentia then she knew it was gonna be hot. I'm 45 yrs old and I would have thought twice to put a HOT beverage between my knees! Jeez! Why do you think our health care is out of control? From people like this - people who sue for tons of money, people who get hurt from STUPID decisions. Plus everyone is lawsuit happy in my book. "During discovery, McDonalds produced documents showing more than 700
claims by people burned by its coffee between 1982 and 1992. Some claims
involved third-degree burns substantially similar to Liebecks. This
history documented McDonalds' knowledge about the extent and nature of
this hazard."

And this:

"Further, McDonalds' quality assurance manager testified that the company
actively enforces a requirement that coffee be held in the pot at 185
degrees, plus or minus five degrees. He also testified that a burn
hazard exists with any food substance served at 140 degrees or above,
and that McDonalds coffee, at the temperature at which it was poured
into styrofoam cups, was not fit for consumption because it would burn
the mouth and throat."

To me, regardless of what stupid thing this lady may or may not have done, McDonalds was knowingly negligent. And that is the main issue here.

Besides the fact that she initially wanted to settle for $20,000 and they turned her down...

One reason for the high temp was so that the coffee would still be hot by the time the customer got to the workplace but McD's research showed that most people wanted to drink their coffee immediately...

Hot coffee is SUPPOSED to be hot. Not warm. The woman knowingly purchased hot coffee and then proceeded to do something stupid.

Sorry to disagree Lou, but when you have over 700 complaints and your own quality assurance manager states "that a burn
hazard exists with any food substance served at 140 degrees or above," You can have HOT coffee without it being dangerous. Their coffee was being served between 30-40 degrees over known hazard temps. If this had been a one time occurrence, then maybe, but 700 complaints is a lot. Also as bjt stated this lady was willing to settle for $20,000 to cover medical expenses which as you can see were extensive. I have seen third degree full thickness burns and people can go into shock and die from these burns. This lady didn't just have a little ouch.

In that lawsuit article, substitute BRP for McDonalds, substitute known steering issues with known scalding temps of coffee, and substitute yourself or a loved one for the old lady and then decide how frivolous the lawsuit was. You can't rail on BRP on one hand and give McD's a free pass on the other.

With 700 complaints in the previous 10 years. 700 out of 10 BILLION is not 'a lot'......Many of us preferred MD's coffee (before S'Bucks was nationwide) because it was hotter than the others.....I'm not arguing the severity of her injuries, only who's responsibility they ultimately are. If I put my hand on a hot stove, is it GE's fault??? I don't think so, I would have only myself to blame..... A hot cup of coffee is ABSOLUTELY NO DIFFERENT....

Selling a hot cup of coffee that is actually hot is not negligence........Lawsuits should be based on merit, as opposed to compassion.....

It's not a matter of compassion. You have a company that knowingly bucked the standard food service safety temps. "Other establishments sell
coffee at substantially lower temperatures, and coffee served at home is
generally 135 to 140 degrees."

No way! You make coffee by pouring BOILING WATER OVER COFFEE BEANS it will be very hot.

Because out of the MILLIONS OF CUPS OF COFFEE McDonalds serves each and every day there were 700 IDIOTS OUT THERE over all the years is no surprise.

Sorry but I disagree. When you buy coffee, you know you are buying a hot beverage. When you buy a Spyder, you know you are buying a machine which could be dangerous. just like any other bike or automobile depending how it's ridden/driven. But steering is different - you buy a spyder knowing it's gotta steer and not go out of control for no reason. You buy coffee, knowing it is hot and you have control about how you handle the beverage - like being in a car with the cup between your knees is just asking for trouble. It's totally different than substituting BRP.

Many times I've burnt my mouth on Starbucks coffee - where I've gotten a blister. I can't even carry a cup outta the store unless I have one of those cardboard thingies wrapped around it. But I didn't sue them. I feel bad for the old lady but it really lacks common sense putting something between your knees that you know is hot and could possibly spill on you. I've only had Mickey D's coffee a couple of times but I'll tell you - that Starbucks is HOT!
