DUI check point, what a way to be welcomed to cuba!

Maybe my original post came across wrong. I don't drink and certainly wasn't implying that people should get away with drinking and driving. Doesn't mean the check point wasn't a hassle.

Coming home from Church one Wednesday night my wife and I went through a license check point. We were in separate cars with I in front, and her behind me. When I was done the officer waved forward my wife, and after checking her license said to her "wow, the guy in front of you has the same last name!" (I had renewed my license since we moved, so the addresses were different.) My wife told him, yes he is my husband. Gave us a chuckle as my wife said the officer turned red with embarrassment. Was it a hassle? Yes, as it delayed us about five minutes on our drive home. Did they catch someone driving without a license, insurance, or under the influence? I certainly hope so.

Constitutionally questionable.[/QUOTE

Afraid you are wrong. Been to court before and found to be constitutional. nojoke

Which court? Its a slippery slope full of unintentional consequences.

Since this works so well for drunk drivers ....there is no limit to the "good" use it can be put to. Heck you could use this to look for anything, drunks today... "seditious" items down the road.

Guess they should have checkpoints for people talking on cell phones or texting--- which causes just as many accidents as drinking and driving.....

Checkpoints like that are illegal in Michigan. Didn't know they were legal in MO. Hope everyone that might have had a beer or two checked out okay. We decided to do our drinking back at the hotel.

While not defending drunk drivers, these checkpoints are more about money than safety - just like speeding tickets - it's big profit for them.

Sobriety checkpoints have been allowed due to the immediate hazard posed by drunk drivers and the States interest in getting them off the road. Michigan Dept. of State Police v Stitz 496 U.S. 444 (1990) As quoted from Full Throttle magazine April 2011 pg. 22 Matt Danielson, McGrath Law Group, author.

LE in North Carolina conduct checkpoints. These are called Booze and Loose It campaigns. Not ony do they check sobriety but registration and drivers licenses and seatbelt use. I have no problem with these checkpoints at all. My daughter lives in Delaware. She was hit head on by a drunk driver in November 2009 at 7:00 am on a Sunday morning. It took her 10 months to recover where she could walk and get back to work. She will have a pronounced limp the rest of her life.

I was a volunteer EMT/firefighter for 20 years. I've seen, all to many times, the result of drunk driving accidents.

I have no problem with dui checks, But what does a dui check have to do with driver licenses etc. What's next? Open your trunk pls. :dontknow:

Well, I'm glad I live in a state where they cannot just pull EVERYONE over and check them for whatever... DUI....insurance...seatbelts... whatever. Illegal in Michigan. They're not going to search my vehicle without a warrant either.

What about the quoted post above your quote? It sounds to me like the state of Michigan is able to establish sobriety check points as well. Perhaps you just haven't happened to run into one yet. :dontknow:

You go Firefly !!! You see how people get upset if you do not share there particular opinion on a topic. People start to attack you for it. I'm not defending drinking and driving but I agree, it should be illegal to do this. You know as well as I do, if Spyderfest was not there this checkpoint would not have took place. This stuff happens at almost every bike event.

Hang on everybody. I was there last nite and left at about 9 pm and did not see them. But this check point, was it on the main hiway and they were checking all cars or was this on the little county road that goes from the hiway to the golf course. MY POINT IS IF IT WAS ON THE MAIN HIWAY AND THEY WERE CHECKING ALL BIKES AND CARS FINE. BUT IF THEY WERE ON THE FEEDER ROAD ONLY CHECKING PEOPLE FROM THE GOLF COURSE OR JUST SPYDERS I HAVE A VERY BIG PROBLEM WITH IT. One is doing the job the right way and the other is selective prosicution and against the equal procection clause of the constitution. I would like to know just where the check point was!!!!!!:lecturef_smilie::lecturef_smilie::lecturef_smilie::lecturef_smilie:

You may want to take a look at this.

Firefly,
I copied this directly from Michigan court records. The case number is notated... Len

The police may search a motor vehicle without a warrant if they have probable cause to believe that evidence of a crime may be found therein. People v Kazmierczak, 461 Mich 411, 418-419; 605 NW2d 667 (2000).

I disagree. Every state is different. In NY (when I lived there) DUI check points were quick and easy if you weren't drinking. They make sure you have your license, and in the process determine if there is evidence of over consumption.

In NC... Same thing, except the check points are there to also net the illegal immigrants driving with out license or insurance. If it takes someone off the road for a few days or a few weeks, then I'm all for it.

These checkpoints are far less common than they were over a decade ago.

A license verifies that you earned the privilege to operate a motor vehicle? So if you are operating said motor vehicle it is reasonable to expect you to produce/verify your license... In which during that time, the interaction with the officer, though brief will allow them to determine if you've been drinking or not and require further screening?

I know that the northern states have less issues with hit and run drivers due to their lower numbers of illegal immigrants. The most common profile in hit and run accidents here in the south is due to the fact that we do not license non-citizens who are not here on visa's. No license, no insurance is a big issue here and license checks can help take a few off the road from time to time.

People sharing opinions are not upset with Firefly. I completely get his point of view, can respect it, but voice my difference of opinion. Firefly and I do that from time time on Facebook. No harm, no foul - he is still a stellar human being and we're still trying to figure out where I fit in.

I suspect anyone else sharing an opinion here feels the same way.

Interesting read......follow the money.

I respectfully stand corrected. However, I would add that at no time has my vehicle been searched nor have I been asked to allow a search. The officer asks to see a DL then checks the license plate. They are always respectful and polite. Every day in my work I have to enter property that has signs posted that say your vehicle is subject to search upon entering or leaving the property, is that wrong? If I don't comply, we loose that account.

Don't you just love it???

Obviously some of us didn't make it to Cuba and are spending a good part of our morning on SL.C. I love how many of these threads diverge from the original topic at times...

It was mentioned previously that northern states hit & run cases weren't as numerous because they didn't have the quite the illegal immigration problem as the southern states...

If you're not too busy...here's an interesting "illegal population" by state map.

The easy thing to do is to just quietly accept "minor" violations.
