• There were many reasons for the change of the site software, the biggest was security. The age of the old software also meant no server updates for certain programs. There are many benefits to the new software, one of the biggest is the mobile functionality. Ill fix up some stuff in the coming days, we'll also try to get some of the old addons back or the data imported back into the site like the garage. To create a thread or to reply with a post is basically the same as it was in the prior software. The default style of the site is light colored, but i temporarily added a darker colored style, to change you can find a link at the bottom of the site.

Got a ticket from state trouper

The 2012 Florida statutes involving eye protection state: Whether a helmet is worn or not worn, eye protection is required by Florida law. (www.flhsmv.gov) Statute 316.211(2): A person may not operate a motorcycle unless the person is wearing an eye-protective device over his or her eyes of a type approved by the department. 316.211(5): The department shall make available a list of protective headgear approved in this section, and the list shall be provided on request.

“DMV.ORG IS A PRIVATELY OWNED WEBSITE THAT IS NOT OWNED OR OPERATED BY ANY STATE GOVERNMENT AGENCY.” This is the website you are using to back up your argument about the windshield being your eye protection. Inasmuch as the FL Statutes clearly state the eye protection needs to be over your eyes, I don't see success in fighting your ticket using this website to back you up, unless the trooper isn't in the courtroom. The Statutes are going to trump whatever website you cite to the judge. I'd pay the fine and chalk it up to experience. It taught me something, since I've done the same thing before, wearing only my sunglasses rather than goggles (won't anymore...have had my visor up a little before while riding in the heat, too, but I'll quit that habit seeing that got someone else a ticket). There are WAY too many bugs down here to ride without a helmet, IMO. I had a gnat fly into my eye when I was on a bicycle once and thought I would crash from the discomfort. Erags got hit in the shield by a BIRD once when we were going 70 on the interstate. That had us discussing the no helmet laws for awhile since neither of us could imagine what would have happened to a biker without a face shield/helmet.

FL is not the only state with tickets being written for crazy things...I got a parking ticket in New Orleans once when I was parked in a handicap parking space, completely within the painted lines with a handicap placard hanging from the mirror. Ends up I was too close to the crosswalk...their law bans vehicles within 15 ft of the crosswalk. It didn't matter that I was in a painted space...in the words of the LEO there, "I agreed to abide by the laws of other states when I got my driver's license in FL." I retorted "...and that means a parking space in NO isn't really a parking space?" I contested it...and lost the fight.

anyone ever had a wasp crawling around on the inside of the shield of a full face helmet while going down the road...upper eye level..? better than a cup of coffee to get you awake

Oh , I found out to never, ever put your elbow on the hood of a state trooper car, nor sit on your helmet, looking bored at 6 in the morning while getting lectured..after having 3 hrs sleep the night before, in Louisiana about 35 years ago.. improper passing.. ok.. this guy slammed on his brakes... and rather than becoming a trunk ornament, I passed him in the emergency lane.. with my radar dectector screaming the whole time.. hair to the middle of my back, wind whipped... I was a guest there, until I got the extra 15$ sent from Houston TX.. where I was the day before.. I carried lots of cash from that day on.. do not rely on credit cards.... Oh and when the 3rd shift comes on never ever try to walk out of the cell, even though the door has been opened all day unless you want your head split open above the eyebrow....

good luck.. I'd pay it and forget it.. life's too short for hassles.. and besides everytime I walk into a courthouse I get screened because I set the metal detector off.. something about all the metal in my false leg.. I avoid those places with a passion

He was a certified law enforement officer doing what you and i pay him to do, enforce the law,

You were disregarding the law, i think that he probably had the discretion not to write the ticket but sometime people dont allow officers the ability to usethat discretion.

Just my 35 years of Law Enforcement opinion.

Well, I learned something new here today concerning statutes about required eye protection. As usual, I am covered. I always wear my helmet and face shield.

I have mixed reaction about fighting it in court. For me it boils down to is it worth my time and money to go the extra step?

I do agree, you met an officer Rambo. The fact that he spotted you, turned around, and then had to work to catch up with you indicates he was going to ticket you for something--no matter what. Its unfortunate you had to cross paths with someone like that.

Most officers would give you a warning and move on for such a small infraction.

Unless they are pushed to write a ticket

The Florida State Highway Patrol is conducting training exercises for its new officers for the next 30 days here in Key Largo. Yes, I was not wearing eye protection, but I felt that the conditions were such that I did not need eye protection. If an officer can ticket someone for traveling too fast for conditions, then why can't a citizen remove his eye protection due to conditions. I am using my wife's I Pad and she is from Colombia S.A., so the spelling check is in spanish. Sorry about mispelling trooper. Come down and visit me sometime here at Gilberts Resort in the Beautiful Florida Keys. I will buy you a beer to go with these donuts.

That is really not your call, the law is the law. That's akin to saying you can park in a prohibited space because "I was only going in for a minute," speeding because "I am a safe driver," or cheating on your taxes because "I need the money more than they do." It would be a terrible world if everyone could just decide at the moment whether the law applied to them or not, IMO. I'm not sure why you would want to add to your aggravation by fighting it, I'd personally pay the ticket and remember the lesson, but to each his/her own. Let us know how your battle turns out.

Really, IM a fun loving guy. I dont know why people need to be aggravated or angry about a traffic citation if they did the bad deed. It has been a lot of fun reading all the responses and I will have to agree that it is best to pay this citation. So on monday I will pay and look at it as one more of lifes experiences.

Then you could have reported back on how you made out.
I fought many tickets in my younger and crazy days, It worked out to 75% in my favor.
That was when i had the time to play lawyer, and have the energy to sit in a court room half a day with the great unwashed.
Now i do get pulled over for odd things, But now days My radiant smile and dynamic personally, Just gets me a warning.:roflblack:

Use commone sense when presenting your side of the situation, the speed you were traveling at, the amount of traffic and how it was stop and go slow. Not all of the judges down there will automatically side with the adversarial oppressors DAMHIK

BTW, we lived in the lower Fla. Keys from 85' through 98' (big pioneers) and I/we don't miss the law enforcement down there one bit at all. For those that aren't aware, there are more law enforcement agencies down there than you can shake a stick at. State police, sherriff, marine patrol, dea, Fla. Keys Nat. Marine Sanctuary, federal wildlife, state wildlife, on and on. Writing tickets and handing them out to the locals and the tourists, it's like shooting fish in a bucket, and the judges know how heavy handed these zealots are. Don't give in, show up in court and present your side. You have a very good chance of beating it
