• There were many reasons for the change of the site software, the biggest was security. The age of the old software also meant no server updates for certain programs. There are many benefits to the new software, one of the biggest is the mobile functionality. Ill fix up some stuff in the coming days, we'll also try to get some of the old addons back or the data imported back into the site like the garage. To create a thread or to reply with a post is basically the same as it was in the prior software. The default style of the site is light colored, but i temporarily added a darker colored style, to change you can find a link at the bottom of the site.

How far is it from Key Largo to the courthouse in Monroe County?What do you charge per hour for your work services either professionally or occupationally? Plan on being in court for at least two hours. I would think that your argument, although quite innovative and creative, would be a stretch, but hey? Who am I to say?

The website that states that a windshield is approved eye protection in Florida is www.dmv.org/fl-florida/motorcycle-license.php. The reason we have lost so many of our freedoms in this country is because people roll over. The distance to the courthouse is 18 miles and what a nice ride on a spyder. Dont worry, I can afford the gas.

The ticket must include court costs because they are asking for $116.00. I mention the speed and conditions because mopeds are not required to have eye protection and I was going slower than a moped. Its still my understanding that one is innocent until proven guilty, so why should I roll over. If any of the really great legal minds that read this post have any suggestions, I am all ears. The windshield on the spyder is DOT approved and I had the spyder attached to me, so therefore I was wearing DOT approved eye protection. Remember, Clinton did not have sex with that woman. I have talked to friends of mine in law enforcement about this ticket and they say I should go to court and plead not guilty. They say the state trouper was out of bounds when he stopped me for a non moving violation in snail pace traffic on a hot day. He stopped me because he could not write speeding tickets.

:doorag:I have never to this day rolled-over, I've lost only once in 4 garbage citations. The lamest one was for picking my nose ...I mean for swerving to avoid a road kill.
NO matter what , on a three wheel it's REALY hard to miss those critters.it all depends on what mood they are inn and that doesn't cut it with me!
here are a few I got in TEXAS-georgetown;
- no helmet > > dismissed:yes:
- no proof of adequate medical insurance > dismissed
- defective lighting (LED's ) > dismissed
- snail-crawl in traffic and got stuck in middle of turn at traffic light> dismissed
- reckless driving (avoiding that huge road kill possum) > dismissed
- I am sure that I am forgetting one ....

That is the DMV website, it is not the law. It won't hold up in court. The law reads:

316.211 Equipment for motorcycle and moped riders.—
.........
(2) A person may not operate a motorcycle unless the person is wearing an eye-protective device over his or her eyes of a type approved by the department.

YOu weren't on a Moped, and in fact were exceeding the 50cc limitation by almost 950cc..
How was the Spyder attached to you? Bolted? Zipped? :dontknow: Unless there's something else here going on; I'd guess that you were sitting on it... I'd bet you a nickel that's not considered as "securely fastened" (As per the wording of the statute)

But I never went to Law School... Anybody else got something that'll help him?

Eyeballs are pretty tough to replace...

Bob, many years ago, in the early 50's, I rode with a friend who had no wind shield and wore no eye protection. A bug hit him in the eye, parts went behind his eye ball....talk about a bad day...he had a bad year, while the MD's were digging guts out from behind his eye ball. I wear a full face and love it. (personal preference) Oh, it gets a little warm here in south Texas but it does not get very cold either....JMHO

Now that love bugs are coming out in Florida again...they were all over the place yesterday...I can't EVEN imagine riding without a helmet and eye protection.

You were disregarding the law, i think that he probably had the discretion not to write the ticket but sometime people dont allow officers the ability to usethat discretion.

Just my 35 years of Law Enforcement opinion.

Well, I learned something new here today concerning statutes about required eye protection. As usual, I am covered. I always wear my helmet and face shield.

I have mixed reaction about fighting it in court. For me it boils down to is it worth my time and money to go the extra step?

I do agree, you met an officer Rambo. The fact that he spotted you, turned around, and then had to work to catch up with you indicates he was going to ticket you for something--no matter what. Its unfortunate you had to cross paths with someone like that.

Most officers would give you a warning and move on for such a small infraction.

Regardless of did the OP break the law or not, it's upsetting that the officer is driving the other direction and made all that effort to get the OP based on something like that. Come on... you guys know there are bigger fish to fry than jumping lanes, u-turning, and creeping up on hot slow traffic day on a guy about his eyewear. While he was writing this ticket, real crime was passing right beside him...
