Florida HOV lane

On a I-95 commute last week, a FHP motorcycle cop pulled up next to me and told me that I was not allowed in the HOV lane. :lecturef_smilie:I was under the belief that motorcycles could use the HOV lane. Federal says its ok and I could find nothing specific in FL statutes. My spyder requires me to have a motorcycle endorsement, I have motorcycle insurance and the registrationsays MC. Any input on this would be appreciated

I would suggest going to the office of LEO unit, with a copy of the law and ask. Saying, under this law I assumed (thought) I was able to to do this. I have done so on a number of occasions, partly for me and partly for question/information for the teen driving school. A polite attitude is manditory. I may be basied here, because I am well known by many because of the Spyder and the PGR missions. Some nobody had a answer for sure. When is a LED tail light with 9 leds defective ?One out? 2 out? The question would be: Does Federal Law in fact allow motorcycles to be driven in HOV lanes.

I will try to find the Federal law, but I belive it states, M/C can not be excluded if federal money was spent to built or maintain the roadway. Anybody else find it, please jump in. Oldmanzues

I would think that it doesn't matter whether federal funds are provided or not. The key would be whether insterstate commerce is used in conjunction with these roads. If that is the case, then federal law prevails regardless of whether state or federal funds are used.

If federal law does in fact state that motorcycles are not to be excluded from roads designated as HOV lanes, then federal laws prevails and state law takes a back seat. IMHO.

MAP-21 gives operating agencies responsible for HOV facilities the option of allowing three specific vehicle classes to travel on such facilities exempt from the posted vehicle occupancy requirements: (1) public transportation vehicles (i.e., out-of-service); (2) HOT vehicles; and (3) low emission and energy-efficient vehicles (such as hybrids). In addition, MAP-21 provides that States may restrict motorcycle and/or bicycle operations on HOV facilities "if the agency certifies . . that such use would create a safety hazard." Generally speaking, most all states have restricted bicycles from HOV/T lanes and some have restricted motorcycles. Check with your state's specific HOV/T rules. Each of the other vehicle types are discussed in the following sections of this chapter and a summary of the requirements for these exceptions to minimum occupancy requirements is provided in Appendix B.

By law, motorcycles and bicycles are allowed to use HOV facilities. However, a State may elect to restrict motorcycle or bicycle (or both) use of an HOV facility due to safety concerns. If a State does decide to exclude motorcycles and/or bicycles, a certification stating that their presence creates a safety hazard must be submitted to the FHWA for approval. Prior to acceptance, the FHWA will publish the request in the Federal Register, providing an opportunity for public comment. After the State has addressed the comments received (if any), FHWA will approve the request. States should submit their certifications to the FHWA Division Office.

If following the road signs the HOV simply states "vehicles with two or more passengers". If your double up your fine. The problem is if your solo (which is 50% full) can you ryde the HOV lanes..I have never seen a sign stating "No motorcycles" other than the cc limitations for freeway use...jmho....hyea:

In most states, bicycles are not allowed on interstate or interstate quality roads. This is normally posted on signs. In Virginia and Maryland on I495 signage states that motorcycles are allowed to use the HOV lane. This is also stated on I95 in Virginia.

+1 Usually when HOV lanes are around you see signs saying "Motorcycle use OK".
