Motorcycle "Safety" Check Points on way to Daytona

There was only one checkpoint coming down 95 yesterday. Every bike had to pull in. They ask to see your license and insurance card. Not sure what the check stops were going north on Rt1. There was ahuge line of bikes there being stoped by the police.

I agree with BajaRon on this....

I think this is all about revenue-- just as speeding tickets are.

In Michigan they cannot do check points like this-- not for anything.

Setting up such a check point when entering a state is really pushing it... and those states will lose out in the end as eventually people won't go to that state.

If they keep this up, I would say it would only take one year of bikers boycotting events in states and they would learn their lesson. Far more $$$ flows into the state because of the bikers going to events than they could ever get with their stupid checkpoints.

They don't have the time or resources to properly inspect all these bikes for safety---- and if they DO check my bike for safety and then something goes wrong and I crash---- are THEY liable since they said it was safe to ride??

While I wouldn't be happy about it, I would get into their 'safety check' line --- but I'll be damned if I'll let them search inside for anything---not without a warrant!

You can say, no search with out a warrant.:lecturef_smilie: And I'll bet they have a JP close by with a sharp pen and a pad of blank warrants.
So figure on being there all day with all your stuff all over the side of the road.
If you have nothing to hide let them have their fun.:D
.

Nothing to hide in my house either--- but they ain't searching that without a warrant either.

This is nothing but a B.S. money-grab. Nothing more. If they want to hide behind their "saftey" story that's fine. But let's call it what it is. The people of the State of Georgia should rise up and nip this in the bud. Do you think for one minute this would fly if they did this to all CARS? They would have WWIII on their hands.

I'll 'think' what I want. I don't have to agree with what is said even if I am in the minority. The LEO's are following their orders; the law as it is at the present time.

Baja is right. I can agree with about 99% of what he is saying. What I have a problem with is when someone (you) make it sound like it's okay not to stop for the supposed road side inspection and then if there is a pursuit with a resultant accident you played no part in it.

It's really funny how you backtrack. In the first sentence you dont agree and you are the minority, and the next sentence you agree 99%. Pick a side !!! And by no means I ever said not to stop for the "saftey" check. Wilmac wrote, "if you don't stop they will chase you down and cite you". And thats were those comments stemed from. So please read thoroughly before you launch attacks. No hard feelings, I forgive you.

So there going to chase down bikes ??? Putting others in danger. Well I guess that no different when they fly by you at 100 mph and you see them down the road at a donut shop.
Isn't there some lawsuit going, to try to make this obvious harrasment and blatant misuse of power illegal ??? Those :cus: try to do that very same thing at Americade here in NY.

I can not recall the exact details but i hope roadkill reads this thread he may remember it, about 1 or 2 years ago in upstate ny somewhere like fonda, rome, utica their was motorcycle gathering of some type and the state police did a motorcycle checkpoint and everyone that rode thru this started a lawsuite claiming discrimination don't know what became of it or if it is still going thru the courts maybe i can do a search see what became of it.

Maybe it's you with a reading comprehension problem. Ron had a convincing argument. But, he didn't convince me all the way.

It could be the donut comment blinded me and I read to deep into what you said when you mentioned the LEO's putting others in danger and the not the person taking off. Also, the LEO's aren't signaling other's out with no just cause; they don't make the laws, only enforce them.

:chill:

Enough of the flame wars guys. If you want to throw rocks at each other, please take it offline.

So what you keep reiterating is there is a WRITTEN LAW on the books that specfically entitles LEO's to target one certain kind of vehicle. I highly doubt it. If there is I would offer my deepest apologies to you. But there is no such written law and that is why there is a federal lawsuit going to prevent this harrassment from happening any longer (providing motorcyclists win). Your acting like what LEO's do is gospel. Ask Rodney King if thats true or not.

I'm just saying they (the ones who actually patrol) are following orders from above.

Scotty,

There was no flaming from either of us. So, don't call any foul. We're trying to get along.

arntufun,

By the way, read the link I posted to Roger. You are right, there is a law suit pending in NYS.

There is no bickering between us. We are two fellow New Yorkers having a conversation and a friendly debate about a topic. This is how we talk to fellow New Yorkers. NO FOUL !!!

:agree:Having spent the first 25 years of my life in Brooklyn i know what Bickering is ; And youz guys aren't any way near Bickering.[yet] :roflblack::roflblack:

Thanks for the link--- seems pretty logical to me this should be illegal.

:agree:

I know this isn't the same; In New York during hunting season the State Troopers take a Conservation Agent with them, NO search Warrant is ever needed .
It stinks but it passed the Court test.

Actually, it probably is illegal. But you'll find that legal and illegal make little difference. It's what can we get away with and what can't we get away with.

The Supreme Court has consistantly found that targeted vehicle stops (like this 'Safety Check') for general enforcement is illegal.

For instance, when you go into California you'll probably be stopped with the intent of keeping certain crop foods from entering the state. Who do they stop? EVERYONE! And there is a specific and stated reason. They aren't fishing for whatever they can find.

Same with the illegal alien check stops. All vehicles, specific purpose. Not an open ended fishing expedition. Neither opperation is a revenue producer for the state.

These 'Safety' stops, on the other hand, are quite different. They are not specific, and they don't address the intent (safety). They simply start with a check list looking for whatever they can find. And they stop only a specific vehicle type. Which again, has been found by the S.C. to be unconstitutional.

So, why do they still do it? The incentive money is coming from the White House, so we can only speculate.

Sure, the officers are just doing what they are told. But that doesn't make it right.

While in the fire service there were a few rare times when I was ordered to do something that was not right. I found a way around it.

You guys may enjoy it, but a lot of us don't. If you won't take it offline, I can. You two are going on my "ignore list"...say goodbye!
