• There were many reasons for the change of the site software, the biggest was security. The age of the old software also meant no server updates for certain programs. There are many benefits to the new software, one of the biggest is the mobile functionality. Ill fix up some stuff in the coming days, we'll also try to get some of the old addons back or the data imported back into the site like the garage. To create a thread or to reply with a post is basically the same as it was in the prior software. The default style of the site is light colored, but i temporarily added a darker colored style, to change you can find a link at the bottom of the site.

Even a disclaimer like that may be pushing the legal limits. I don't know, I am no lawyer but it seems like there has to be some sense of fair and expected delivery and service. Just my .02.

All of this info was not on his site 2 days ago. You didn't have to read and click the x to enter his site. I'll go to the bank Monday and file a complaint but they told me the other day if it's over 120 days there isn't anything they can do.So like I told him in an email i guess I just got ripped off for 1500.00 bucks.When he took the order he didn't state any of this and when I finally got ahold of him the other day he never said anything about it either.It just apperaed on his site .
 
Marcel is grasping at straws... no way his little disclaimer would hold up unless he has your signature on something agreeing to such long waits and no refunds allowed.

Visa/MC will back you guys on this kind of thing. If the long wait isn't reason enough, the poor quality sure is. Visa will protect such purchases and give you your $$$ back in almost all cases.

I've tried to shy people away from him for just this kind of thing. Also check where your Visa was actually processed through. Mine for a shield went through some sign shop in Nevada...:yikes:. If he's doing things like that, then what else is he cutting corners on?

If he doesn't really have the right kind of Visa account to take orders online or over the phone (just a guess that he might not)--- he can get in big trouble with his Visa processor. A retail (on-site) terminal has different rules than those used for phone/online orders--- and the on-site people pay a lower percentage because the risk is lower. Get caught taking numbers over the phone or online with a retail-only account and you've got big problems as a merchant.

If he didn't clearly state NON-refundable when you ordered-- then he's outta luck. He really can't afford to screw a bunch of Spyder owners out of that kind of money--- his reputation is already in question--- now this.

Makes me wonder just how many have asked for $$$ back if he went to the trouble of making up this new disclaimer. He did a similar thing on his shields--- added a disclaimer online about them not really being DOT certified.

This guy is just BAD NEWS.

If you decided to make this a legal issue, they can prove when he actually put that disclaimer on his site. Putting it up after the fact does not protect him. Also a disclaimer in and of itself doesn't protect you. Many companies have been sued and lost regardless of their disclaimers. I think you should fight for your money.
 
When filing with your Visa I would simply state... you ordered the items and did not receive delivery. His 12-14 months that he is suddenly pulling out of his :cus: would not be considered a 'reasonable' time frame according to the UCC (uniform commercial code).

Restocking fees are only legal if you are told about them at the time of purchase. They were basically 'invented' by the big box electronics stores to stop people from 'borrowing' big ticket items for a few days and then returning them (big screen TV's for Super Bowl was a big one).

His new disclaimer does NOT apply to anyone buying items before he posted it-- and would be difficult for him to impose anyway.

He also changed the design of the rear bags-- and some have said they hate the current look--- they should be able to get a full refund.

The term Con Artist comes to mind.....

I hope you all get your $$$ back--- remember--- this isn't just about getting your money back--- it's about stopping this from happening to others in the future!
 
I guess I will be trying to contact Marcel next week to see what kind of line he hands me about my fairing and vents that I ordered and have not heard anything about. I was hopeing to get the fairing because the ones I saw in person looked good except for the paint work.:spyder:

:agree: with the others - call the credit card people. You never received it and you should get 100% money back! How can he charge you a restocking fee for something you never received?:dontknow:

Agreed...how people want to steal from others is unbelievable to me. Lemme see...you have a product, you wish to sell it, you take peoples' money, and then you never manufacturer the part and you leave them high and dry. Are you kidding me? You can contact the state attorney's office in whatever state he is in...they will shut him down, no question about it. It seems like there are several people with similar problems. The state will get involved with this being he's a merchant with a business licensed in the state...and if not, he's in even more trouble...

I would like to say that we're very fortunate to have great sponsors on this site. Lamont has done a great job making sure the merchants here take really good care of us. I don't think I'd buy anything from anyone (other than a BRP dealer) who isn't listed here...it just isn't safe!
