Cops in Cuba......

Roger,

That's called exercising your right to freedom of choice. Someone else may feel strongly and send a letter to their representative stating that they agree with checkpoints. It's all freedom of choice.

It's not about whether drinking and driving is bad.
It's not about whether or not checkpoints save lives or have a positive result.
It IS about whether or not such checkpoint are constitutional and a violation of our rights.

This is a battle that has been fought many times...many, many, many times...in regards to Bike
Week in Daytona, Laconia Bike Week in NH, Bike week in Myrtle Beach, Bike Week in Sturgis, the list goes on and on.

It's not about whether drinking and driving is bad.
It's not about whether or not checkpoints save lives or have a positive result.
You know something... I'll buy that premise!

So lead on, Arr... ;)

And I STILL don't mind hitting checkpoints; the LEOs are out on the road; their presense alone may give some folks something to think about...

I think we thank veterans for our right to freedom of choice.

I learned my lesson last year on debating checkpoints here. My feeling on debating anything is it's better face-to-face.

The one thing I will debate you on is: veterans, not vetrans.

If It's my freedom of choice, I choose not to agree with these checkpoints !!! :roflblack:

Opps !!! :opps: Sorry, I'm not a very good speller. :(

I would never ask you to change your opinion, thats what I like about you. :2thumbs:

Go away to ryde on my :spyder2: for a couple of days and come back to see we have the livliest thread in a long time. I am kind of liking all sides of the argument so have nothing more to add there. All above are 'hot butten" subjects and we are not going to win all the arguments with the strong opinions on all sides.

Me: I am still at where I will have a drink once in awhile in moderation. I don't like checkpoints that profile particular drivers. I will stay out of the guns stuff. I may have some, I may not. The NSA can figure it out.

The craziest checkpoint that I can remember was on the opening day of fishing in Northern Minnesota. Half way between Duluth and Grand Marais, on the North Shroe Drive, the Game wardens were pulling over every vehicle pulling a boat. They went through everyone's coolers checking for overlimits of fish.

Did you ever think that they were doing it to keep people safe?

I know everyone is assuming that they're doing it to make money... but that's just plain silly. Even if they pulled over and ticketed every one of the hundreds of Spyders that might have crossed their checkpoint they would break even at best.

They made a big deal about it so everyone would talk about it, and then be more careful about riding after drinking.

Hey, if you can have your completely uninformed assumption I can to right? Cuba's got some pretty nice people there. I'll assume they're trying to keep us safe from ourselves and each other.

You may now resume the conspiracy theories.

I knew you drank the cool aide down there!:D

One DUI ticket would net them thousands.....then there's all the other tickets they'll nail people with.....no insurance card, license problems, etc.

Regardless of whether they're doing it for money or safety (it's a combination IMO)......it's a violation of the 4th amendment.

Plenty of other things they could do to keep us safer from ourselves too....

Good discussion and good points on both sides....but I'm gonna stick with personal freedom.

Oh...and yeah...I watch Fox every time I need a good laugh..... ;-)

It is not the checkpoints that I object to as much as I object to being targeted because of attending a Spyderfest event in Steelville. Seriously, a checkpoint on Thursday night? No matter what is said that is the part that I object to. That's all I'm saying about it. Had a GREAT time at Spyderfest!

TOTALLY AMAZED

I thought I could walk away from this But I am amazed at the thought process some of the people here are vocalizing. Where should Law Enforcement go looking for POTENTIAL DUI violators...the parking lot of the Mormon Tabernacle Choir ( no offense to Mormons ) or a BAR where there is going to be a KNOWN large congregation of people.....Not Spyder people ...just People.....If it had been the Corvette Club the cops would have been there for that too, or maybe even the Shriners (no offense to Shriner's either)....if the cops get a tip about a Bank robbery at 5th and Main st. , do they set up at 20th and State st.......Do you get it now.....Mike.....Be Happy.....

I stayed at the Days Inn in St James and the Mc Donald' s next door had a sign about Prom night and no DUI. Maybe the road blocks were part of an overall plan to deter drinking on the prom nights when emotions are high and our children are at greater risk. A quote from the Corps "for the good of order". I try not to dwell on the negative and remember what a great event and all the great people I met.

I totally agree with Blueknight911...

We've learned to live with it here in our little community...Every Wednesday, Friday and Saturday nights they position themselves right next door to every bar/drinking extablishment in the Township to "monitor traffic patterns" on a 2 lane street...Such as it may be we learn to live with it as we don't have any other choice other than to move...

And would it be okay for the cops to stop EVERY car going down the road near the bank and search them for stolen money?

You are advocating stopping people and checking them for what they *MIGHT* be doing. Think about that for a minute.

What if they stopped every car with a child in it and questioned the child as to whether the adults in the car were molesting them? After all-- you just *MIGHT* be. I supposed you'd be fine with that kind of stop?

I'm flabbergasted that so many are willing to just give up their rights at the drop of a hat... unreal. Seems many would have been fine with the Germans searching your homes too.

If they want to search me, my car, my Spyder or my house... I'll demand to see a search warrant that specifies my name. A 'catch all' warrant that they *might* use at checkpoints shouldn't be legal IMO.

Although the Supreme Court notes in Saenz v Roe, 98-97 (1999), the Constitution does not contain the word "travel" in any context, let alone an *explicit* right to travel, the presumed right to travel is firmly established in U.S. law and precedent. In U.S. v Guest, 383 U.S. 745 (1966), the Court noted, "It is a right that has been firmly established and repeatedly recognized." In fact, in Shapiro v Thompson, 394 U.S. 618 (1969), Justice Stewart noted in a concurring opinion that "it is a right broadly assertable against private interference as well as governmental action. Like the right of association, ... it is a virtually unconditional personal right, guaranteed by the Constitution to us all." While the Articles of Confederation had an explicit right to travel, it is now thought that the right is so fundamental that the Framers thought it unnecessary to include it in the Constitution or the Bill of Rights.

4th Amendment:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

As far as 'prom night'. We gave them the benefit of doubt last year because it was a Friday AND there was a prom. But this year was Thursday. I've never heard of a prom on a Thursday.
