Accident and Spyder totaled

Very happy to read you are seeing your family Doctor. Can not say enough about that. Sometimes even this checkup does not show all that is wrong. And a few months down the road things show up. Just be aware of that if you are not already. A bike can be replaced, you cannot be...

Also, Insurance companies make a reasonable effort to make you whole again. If you smell a rat please ask for help. Many of us assist folks after losses to best make you whole again. Try not be embarrassed or upset if you get a lower than expected offer from them. At the end of the day they want a happy client, and a reasonable compromise. However it is not unusual for them to try a bit low the first time through. There are perfectly legal/legitimate ways to find that compromise. They use programs that pull values from Actions and such. We in the general public use Kelly Blue Book and NADA. The happy medium is normally closer to what we use.

How many times have you heard, "I'm glad that I'm okay."
And then they're in the emergency room that night or the next day???

:opps:

I missed your post. Yes sadly, this is true. Lost a client a few years ago... Long story short. he called me on the side of the road after the accident... Vehicle totaled... Not his fault... Told him what we tell all our clients ("We" being you and I and the Industry we are in) and to go see his doctor now or sometime today... At the scene he refused ambulance help. Spoke with him two days later again as we worked with the adjuster. Said he was sore and his chest felt "Funny". Dead three days later. Torn Heart Muscle. He went to do a "Calm" workout and never made it out of the gym...

Do not be afraid to ask for all of your aches and pains to be thoroughly documented and evaluated by your physician. This is not the time to be stoic!! As others have said, good that your here to tell the story, now is the time to spend the time and energy to completely document and evaluate any and all injuries. There is no minor injury at the current time. Glad your wife wasn't with you at the time of your "accident" Heal and be well. Decide what color you want on your next spyder!!!

I hope you fair better with Progressive than I did. New frame new parts for my 2011 RTL. My story is for another time.

The important thing is your safe!
I wish you all the best.

Accident

You say that KY is a no fault state. In PA , they are a no fault state also.If you have an accident like you did(SORRY ABOUT THAT) it only means for the insurance. You can sue the person Ins Co.who caused the accident up to your limitations on you insurance. If you have underinsured and uninsured, and collision coverage. I went thru the same thing that you are going thru. Get you self a good lawyer. Let him handle it. The cab driver should be charged for the accident. Good luck

First off, I am SO glad you are okay. Protective arms were indeed wrapped around you.:bowdown:

Ive been thinking about this though...... A question for the physicists and/or engineers....if the OP was going 60 (obviously the taxi was doing more), wouldn't the impact speed be measured by the difference of what the taxi was doing? If the taxi was doing 75 and the OP was doing 60, wouldn't the impact speed be measured at 15 mph? :dontknow:

Regardless, the Spyder is indeed a hero. :firstplace:

Basically yes.

However similar to a dead stop, and being rer-ended with that person hitting you dong 15mph... It is suggested to multiply the weight by 10 for a reasonable measurement of the impact force.

Basically... Imagine you have a 15lbs watermelon in your arms... Drive into a wall doing 15mph, and that watermelon now weighs approximately 150lbs. Try to hold onto that...

There is far more to it, but the problem is this. Our internal parts all do NOT all have nerves to tell us something is wrong. And all our internals are liquid and move around. Sudden impacts can and do cause damage. However enough damage is not known until other internal parts of our bodies with nerves are now inflamed, bothered, or what have you.

This is why it is absolutely critical that we tell our doctors "Everything". Let them earn their $$ and do their best for the patient. More often than not, most adults we all know can look back at an accident they had and relate a current chronic pain, knee surgery or what have you to that accident. But at the time needed to work, felt it was just sore muscles, or what have you. Only now it is on their nickle and not the insurance it should have been. Not to mention the arthritis and other issues we develop as a result of improper healing/recovery.

Quick example... A personal one... Earlier this year I injured my shoulder... Waited a month before seeing my doctor. And I am being 100% honest and factual on this... Remember... This is coming from me helping others and knowing the right thing to do...

Anyway. I went in for my yearly "Yes dear I did that just for you" checkup. While there I mentioned my shoulder hurting... Also keep in mind we had a really bad winter storm I cleaned up after. Chainsaw, you name it. Three weekends in a row to clean up the yard... Popping Advil and an evening Brandi to help mask the pain.

My doctor has known me for say... 25+ years. She looked me straight in the face and said... What? Tell me what happened, and what hurts... I do... She looks at my wife and says... Let me guess. He thinks he is hiding it from you and you told him for the last month or so to see me about it... She tells me to follow her... Get's X-Rays... And tells me I need surgery for my rotator cuff...

My point... I hurt... Could manage it... Have a business to run and a disabled wife to help. No time for aches and pains... When they did the MRI I was shocked to see my bicep muscle had nearly turn completely off not only my collar bone area and front chest, but my back area of my shoulder as well. And my doctor was correct. The rotator cuff injury was far more significant than I would have ever thought.

Our bodies are far to complex to mess with. I know it, and I still pushed my luck. All I can offer is my knowledge and personal mistakes as an example... Everything is still up to each individual...

After looking at all your pictures, I am so glad you are doing ok and off to see your doctor. We will keep you in our thoughts and prayers for a rapid recovery.

Doctor said everything appeared OK but If anything changes over the next few days to let her know. I reported the following to her: headache since accident, front of me neck (not the back), upper rib cage beneath my arms, and right knee. She did give me a shot of toridol and it helped me get my first good nights sleep.

If the insurance company settles everything to my satisfaction, I don't see a need for a lawyer at this time. If anything goes awry, then the rules of engagement will definitely change.

Will continue to to update you all on this process.

Glad to hear the update with positive results

There really should not ever be the need for an attorney. To many of us here willing to educate/inform you of how to best be informed (Assuming you even need any help) so that the insurance company knows they are working with a person that is informed. And they normally counter offer with a reasonable settlement...

It has been a few years sense I lived in Kentucky... But I do not believe they have PIP, is that correct? If so, are you able to go after the Taxy driver or company for any medical issues that may come up?

To the OP, I'm glad that you made it through relatively unscathed.

As for the statement above, I believe it is incorrect. Every part of our body is connected to our nervous system; either the CNS (central nervous system) or the PNS (peripheral nervous system). Okay, I don't want to stray to far off of topic.

OP, I also hope your insurance experience is a smooth one.

:opps::opps: I failed to proof read my typing. Yes every part has some kind of connection the nervous system. Not all of them respond/report/work the same with timing, level of alarm ect.

Sometimes a part of our body that hurts more than another is actually the response to the other portions reaction to the injury. And why it is important to talk about all the irregular aches and pains. Yet even in other times we do not know anything is wrong do to the level of discomfort not being one of concern as a result of our past experiences, only to find out later on that it was. "That" is what I was speaking to, thought I typed, and failed to... :opps::opps:

New to this, I had to look up PIP and it appears KY has it:

http://en.wikipedia.org/wiki/Personal_injury_protection

Wiki is not always on top of things... While I find them to be generally accurate, they are not in this case. Note the first sentence. It says "Car Insurance". It should say Automobile Insurance.

Motorcycles are not Automobiles, but trucks and campers etc are. I can say without any worry., that even thought Washington State has mandatory PIP for automobiles, the following is fact.

Any admitted carrier in Washington State does not even offer PIP in these two areas...
  1. Motorcycles
  2. Any business that is NOT a Sole Propriorship.

Only Medical is an option up to $10,000.

I hope that helps

Just so you'll have something to use as a benchmark. I had a 2010 RT-S Limited with 24,000 miles. My accident was last February, 2012. My insurance was Progressive. The lady that ran the red light and T-Boned my right back side had Progressive. Progressive totalled my spyder and gave me $26,500.00. (soon to be used for my 2013 RT-S) Hope this helps.

Chris
