Has anyone ever opened a Paypal dispute?

I ask because I will be starting one tomorrow. The basis will be that the product is not sold as described/false product information. On May.14, I purchased a Lsotta windscreen for my 2022 RT S2S through Omnia Racing in Italy. I purchased via Europe as their is no USA vendor for this windscreen. Cost was $245/shipped, with payment via Paypal. Amazingly, the windscreen arrived in only seven days!! The windscreen arrived very securely packaged, and it is a beautiful windscreen. In the box, I found only the windscreen and (4) stickers. No directions or mounting hardware. Those with 2020+ RT's know that the windscreen mounts with (4) M6x20 screws. The Lsotta windscreen came predrilled with approx. 20mm holes. Below is the product description from lsotta. https://shop.isotta-srl.com/moto/pa...originali-per-can-am-spyder-rt-2020-2023.html Please look closely at the second paragraph:

Maxi windshield on original attachments for CAN-AM SPYDER RT 2020/2023

The original attachments ensure a safe and stable mounting, maintaining the aesthetics of the vehicle. The ease of installation is further facilitated by the fact that the product comes with a bag of screws and mushrooms necessary for assembly. These useful accessories make the installation process quick and hassle-free, allowing you to quickly enjoy the benefits offered by the Maxi Isotta windshield.

By choosing this windshield, you not only get more protection while driving, but also a touch of elegance and functionality to your Can Am Spyder RT. With Isotta, you can count on high quality products and carefully studied design to improve the driving experience.

Technical features:

  • Isolde Quality
  • 100% Made in Italy
  • Easy assembly on original attachments
  • Material: PMMA
I did NOT receive the "bag of screws and mushrooms necessary for assembly. After reaching out to my Omnia racing vendor customer service, I was advised this:
"Good morning,
this Windscreen, as stated on our website, mounts on the original hardware, therefore extra mounting kits are not required."

After including the product description, he replied back with this:
Good morning,
sorry for the misunderstanding, but did you not receive the screws at all?
In that case, you will need to contact Omnia Racing from whom you purchased the article and they will provide you the missing screws.
For further information, you can just contact me
Best regards
Francesco Bock

Francesco then forwarded this info to his supervisor, who replied:
Dear Sir,
as indicated on our website, this windshield must be installed using the original mounts, we only supply the glass panel.
Kind regards.

The supervisor at Omnia Racing echoed their sentiments. I then requested a complete refund/prepaid return shipping based upon fraudulent product information. After two days, I have not received a response. Also, with my messages, I supplied photos of the OEM product and their product, and how it would mount without specific hardware. I will supply paypal with email correspondence's, Lsotta product descriptions and photos. They received several more, larger photos than the ones I attached. Not sure how this will go, but I guess we will see.

Anytime you use Paypal or a similar payment format, it is very important to use a credit card for a 2nd layer of protection. It's best to go through Paypal first. But if that fails, your credit card is usually a more reliable and responsive route to go.

When Marcus at M2 folded, Paypal was just acting like an AI mediator. There was zero participation from Marcus who was just dragging out the process because he had XX days to respond before it would move on to the next step. I called my CC issuer for advice. They told me to file a claim with them, which I did, and I received a full refund immediately.

OK... Thank you. My PP funds are linked to a debit card through my credit union. Not sure if that'll work, but the purchase was certainly erroneously advertised by the manufacture. We'll see. Thanks.

Good luck to you. I hope you bank stands with you on the deal.

I don't even have a debit card because I feel it's another layer of protection from a scammer being able to get into my bank account. With a CC, your money isn't already gone from your account, so the bank has a good reason to advocate for you so they get paid?

Unfortunately, debit cards are typically not nearly as good at protecting you as are credit cards. Paypal with a credit card is the safest way to go. I wish you the best of luck. But sometimes education can be expensive. We've all learned the hard way on occasion.

Well ... We'll see how the PP dispute goes. Hopefully, my supplied photos and erroneous product description carries some weight. The product description clearly states "The ease of installation is further facilitated by the fact that the product comes with a bag of screws and mushrooms necessary for assembly." and I got none.

I totally agree that you have a valid grievance. And Paypal or your debit card may well cover you for this. Being International adds another layer of difficulty for recovery. And even adding the credit card angle is no guarantee.

I got taken recently by AliExpress because I was careless. I'm still kicking myself for that one.

Well ... Maybe a bit of good news. My Paypal is linked directly to my Ultimate Checking account. I called my credit union and they said that they can certainly open up a fraud case based on product misrepresentation and listed goods (parts necessary for installation) not being supplied. That makes me feel a bit better. We shall see...

@troop Older RT models came with the larger holes. If you like the windshield you can get some 20mm (3/4 ") grommets and flat washers at your local hardware and mount with your existing 6 MM screws.

Good info. Thanks. I measured the predrilled holes with a caliper and they're 15mm. If the predrilled holes are actually for 2019/older RT's, they truly do need to include specific mounting hardware.

This might be the cheapest fix, not negating the fact that the hardware should have come with the windshield.

The retailer notified me this morning, asking for one more attempt with the MFR to see if there is any mounting hardware. If not, he'll start the return process. I told him to skip the sales dept. and ask to talk to somebody in the technical/R&D department. With there being a seven hour time difference, all my received messages arrive between 2A-3A my time. And both the seller and MFR have split hours of operation. They're open 9A-12N and 1P-5P their local time. They're closed at 10A my time. :)
On a side note, I saw these on Amazon. They use M6 screws (check) and the grommet is 4mm, as is the thickness of the windscreen (check). I know the predrilled Lsotta hole is 15mm. When these arrive today, I'll use my calipers to measure the inner grommet diameter. We'll see how it goes, as I really like the windscreen.
** The inner diameter of these grommets are 13.5mm. I'm thinking they would probably compress enough to make the windscreen secure if I just ground down the inner sleeve a couple mm's so they wouldn't be flush with the bottom portion of the grommet. **

WOW ... Talk about fast!! I just saw that my credit union deposited the full purchase price of $242.08 of the windscreen dispute into my checking account, calling it a dispute settlement. I logged into PayPal and it stated they were working with my banking institution to settle this. I guess I'll see overnight what happens with the vendor? They'll need to send me a prepaid shipping label and completed customs forms, then I'll send back the windscreen.

Yes ... The 2019/Older RT's used grommets/sleeves on their windscreens, but the supports are the same. Lsotta lists their shield for 2020-2023 RT's, but still drill/use the bigger holes (grommets/sleeves) versus the M6 screws on 2020 up. Lsotta R&D made a BIG GAFF.
IF the holes on the Lsotta windscreen are the same size as 2019/older RT's, I'd need to buy:
(4) rubber grommets (705003756) at $5.19 each = $20.76
(4) steel insert sleeves (705005756) at $12.49 EACH = $49.96 for a total $70 extra $$
Yeah, I got my money back, so I'm done.
I did send Lsotta this info. Maybe they'll throw me a freebee...
