There are many benefits to the new software, one of the biggest is the mobile functionality. Should it take 4 months to fix my Spyder?

Questions

My 2011 RT-S has been with the dealer for over four months! This does not include the previous three times it has been with the same dealer for the same thing...... limp mode home and no power steering. The steering actually went out while I was taking an off ramp and luckily I was able to control it before going into on coming traffic. BRP has even had their "techs" assist with the repairs and to date nobody has been able to fix it. :banghead: The only thing I hear from the dealer is " I dont know what is wrong with it" & " I just want to put this Spyder back in the crate and ship it back to Canada" ....... I guess I will just dust off my Suzuki cause I just want to ryde.

You need to find a new more competent dealer I cannot accept that it has taken this long to be fixed:lecturef_smilie:

Ditto that. I know I am lucky to have a wonderful dealer, Cowtown, only three hours away. But I can't imagine leaving my RT at any dealer for four months. I would take the time to trailer it to a competent dealer even if it took me a week to get there. I HATE to hear these stories, and especially since this is the OPs first post. I don't know the good dealers on the west coast. I think Murphy Brown found one. The OP should PM her for a contact and then go take his/her Spyder away from a dealer who isn't resolving the problem. It is a complicated machine, yes. But FOUR months to diagnose a problem is not acceptable.

Contacting Carlo from BRP would also be a step that I would take ASAP.

Sorry folks. I am usually not irritable. But it is this kind of stuff that gives the spyder haters ammo.

I don't know about the laws where you live, but here in CT, anything more than 30 days allows you to take action under the Lemon Laws.

Hi, I read your post and my blood pressure goes UP...but there is a solution....first and foremost get ahold of Carlo at BRP...he is the head tech dude...have found him to be incredibly responsive and helpful...my dealer is in Spokane, WA...hopefully some of the CA Spyderlovers will read your post and give you their dealer info...did you check out the list that was created here on Spyderlovers about dealer recommends or NOT....I will look for that thread and hopefully get back to you....I am not very efficient to find such things...so if someone else (aka Lamont) reads this hopefully you will get that help that you so desperately deserve ... ok just keep breathing there is a solution just gotta help you find it. ....

Here is CA list of dealers...

http://www.spyderlovers.com/forums/showthread.php?11226-CA-Dealers-List

Now the problem is I do not know anything about them as far as are they reputable, reliable and recommended.....I do know that Bert's Mega Mall has come highly recommended. Hopefully those folks from CA will jump on here and help you sort out the great from the not so good... I know that I ryde 1 one 4 hrs to get to my dealer.......and would ryde many more hrs if that is what it takes to get Ms Spyder "fixed" and road worthy....
Had a human error on my ryde last year and found 4 great dealers from NE thru WY and MT they all kept me ryding and working way back to WA state....but they are a reallllly long way from CA....
Keep :D :banghead: reallllly hurts.....

I don't usually advocate this, but I'm quite certain that California is a lemon law state for motorcycles. If anyone ever qualified, you certainly do. There are specific requirements and procedures for making a claim. I think it is you should contacted a lawyer to begin the procedings. It's time to get you a new Spyder. JMHO.

This definately sounds like dealer issues. Advice to call Carlo is good. If that does not result in your problem being resolved soon, then Lemon law pursuit is advisable.

Nope, State by State. But they should be all 50.

Yes, "should" be, but not necessarily so. Michigan's lemon law specifically excludes motorcycles and trikes by excluding vehicles designed to travel on less than 4 wheels. Other state laws may vary, but a number of states do cover motorcycles and trikes.

4 Months!!

That is outrageous !!! One month would be more then enough to make my blood boil and demand my money back, not a new bike. If they can't fix it then they didn't build it right!! What guaranty that the next one would not be the same! Good Luck as it seems so many of us have not had your issues and Luck must have a lot to do with it!

Approximately half the states exclude motorcycles from their lemon laws.

I don't know who your mechanic is or where you go, but you don't live that far from elkgrove, so if you can I would take the drive to there and drop it off at elkgrove power sports. That's where I bought my 2010 RT-S and I've had no trouble's with them at all, they've taken very good care of me if I come in with a problem and usually can get it fixed in very short order. I've found that they are a very competent spyder dealer. so far

Some on-line research yielded this, which indicates that the CA lemon law does not apply to motorcycles:

  1. [h=3]WHAT IS A NEW MOTOR VEHICLE[/h] The law discussed above applies to "new motor vehicles." (Certain limited protection may apply to used vehicles as described in Section 2.) The term "new motor vehicle" includes not only new motor vehicles but also demonstrators; the chassis, chassis cab, and propulsion system of a new motor home; and any other motor vehicle sold with a manufacturer's new car warranty. For example, a two-year old used car sold with the remaining one year portion of a manufacturer's three-year new car warranty would be treated as a new motor vehicle. The term "new motor vehicle," however, does not include motorcycles or exclusively off-road vehicles.

(Underlining added) However, this does not mean that there is no recourse, as 4 months in the shop would likely be deemed unreasonable by any judge or arbiter under the terms of the new vehicle warranty.

We have been told Carlo is aware of this issue

We have spoken with Damien @ BRP who says Carlo is his supervisor and he is aware of my issue. We do have a very good case for a lemon law suit here in the sue happy state of California but that is my last resort but I have spoken with an attorney. When the fourth time came around to tow my Spyder to the dealer I asked Melody @ BRP if I should take my Spyder to another dealer and she said " No you want the same eyes working on it" Well that was four months ago. I would love to get another spyder since I have so many friends with Spyders and if they have a problem it gets fixed in a few days or the most two weeks. Granted they no longer take their Spyders to the dealer I am using and they are not even buying their new Spyders from them anymore. Thanks everyone for your comments & suggestions, again I dont want to come across as a Spyder hater because I am not. I do however hate to file a lawsuit but paying for a bike that I cant ryde is crazy! The dealer did give me a loaner to ryde and I rode it for a few days until I was told by law enforcement that since it doesnt have a dealer plate or valid California registration paperwork if I get pulled over they will tow the bike & I most likely will be taking a ride in the squad car.....grand theft auto wont look good to my boss since I work with the DOD

PS: I also own a Can Am Outlander Max (love it too!) and what came in the mail the other day............Safety Recall Notice ....... the DPS!

PSS: My next step is the News Media maybe that will get BRP's attention

Sounds like you are on the right track. We are all pulling for you and by no means do you come off as a spyder hater. But those bad dealers really do give the machine a bad name. Best of luck and please keep us posted! You are part of a good group of folks here on SpyderLovers!
