Yes helmets are required in Ca and even if it is a private housing area it's not a private street only for her use so she is breaking the law.

No offense but I hardly call a zip up and down a residential street "riding a spyder".

Sorry to be negative about this but I bet you money you will never see her with a helmet on riding down the 405 freeway or even Hollywood Blvd for that matter!
