Who should pay my ticket? Motorsports of Tampa?

Lamonster

SpyderLovers Founder
I ordered my Spyder June 7th 2007 from Motorsports of Tampa. They called to have me pick it up Dec. 15th of 07. When I went to pay for it they said that they went ahead and registered it in Frank the service managers name because that was the only way they could sell it to me. They said they had some sort of agreement with the state of TN and that this was done all the time and I could register it in TN after 6 months. I thought it was strange at the time but I just traveled 700 miles and I wasn't going to argue the point seeing I didn't know if that was a problem or not. I did think it was strange so I got the Finance Managers card just in case I had a problem.

So a couple of weeks ago I get a ticket for a FL tag while living in TN. I told the cop the same story they told me and said he never heard of that and wrote me a ticket. So I go down to see if I can register my Spyder in TN seeing it had only been 4 months and guess what, no problem. I call the county where I got the ticket and they said great, that will be $69.00

So now I'm getting upset that I was lied to and I call and ask to speak with JT, the guy who told me all this. Well JT no longer works there so I asked to speak with Frank my sales guy. I was put on hold for 20min. and Frank never picked up. I left a message for him to call and he never did. I call back the next day and ask to speak with Frank again, he never picks up and the gal asked if I wanted to leave a message. I told her that I tried that the day before and he never called back. She said she would make sure he got the message and would call me back. Guess what, two days later still no call back. Now I'm getting ticked off.

So what would you guys do?

You were obviously lied to, and more than likely they broke some sort of law.
Now that the Spyder is registered in your name and in your state, I would at the very least report him to the authorities in either your state or in FL or both. I would register a complaint with the BBB. And depending how far you wanna take it (I would probably cut and run after these two things) you could probably take him to small claims court for ticket fees, re-registration fees, etc.

Its all up to you, but if its all straightened out now, Id cut my losses, and stress level and register the complaints and be done with him.
I hate to hear these things. Sorry you got shafted.

My question would be.....What's wrong with the cop? Why couldn't he just give you a pass on that, and give you a chance to straighten it out? I know he was just doing his job, but c'mon!

As far as the dealership is concerned, I agree with teacherbob....go directly to the owner of the place. Then you may get some answers, or at least you will know that your situation was heard by the top guy. Heck, this kind of thing would make me so mad that I might spend $1,000 just to get a $69 ticket covered by the dealer! But that's not too smart. :-[

Why do you think they put it in Franks name? This is really weird. Anyway, hope you get some answers.

Well it wasn't in Frank's name per say but they used his address as if it was mine. I wasn't about to lie and say I lived there too.

It sucks that kind of thing has happend to me when i was workin on a car of mine.. you really cant do anything.

But ill tell you what feels good is .. is when you go to his shop unexpected and you tare him a new :edit: !!

That should fix em good.

Can't you go to court and fight the ticket? Explain it all to the judge and take your chances.

Don't know for sure why they would want to register it as if you were a Fla. resident, but my guess would be that they didn't know how to register to an out of state buyer as far as collecting taxes and/or registration fees... and were too lazy or inept to figure it out. Easier to just collect it.
As far as what to do now, I'd do a bit of research on Florida DMV to find out what they should have done and then file a complaint with the owner, DMV and BBB.

I would suggest speaking with the owner for a solution, Let them know that if you can't agree your considering reporting the transaction to the Fl DMV. If they don't reach a satisfactory conclusion, do it. As a liscensed dealer they won't want a complaint of this nature in their file as to many of them would likely result in a fine.
Going forward, the members here could help weed out the poorer dealers if we established a rating board based on our experiences. Similar to what Edmunds has for cars. If nothing else, it would help others avoid problems and help to funnel business to reputable shops.

Definitely go report them to the BBB and then drive down there, pull a nice big ole double wheelie with the Spyder right through the glass doors of the place!

Seriously - file w/ the BBB and I would do a number trash talking them.

I would do a number of things.......first I would contact BRP VP of Dealer sales and tell him the Story.....I believe BRP currently is soliciting Spyder owners on Dealer satisfaction and this nightmare takes the cake! I would also contact you r local State Rep for procedural protocol on a Florida dealer collecting vehicle sales tax that belongs to Tenn........they Blew smoke right from the get go and it sounds flat arss shady........I bought my Spyder from out of state also.......I got a temp tag, my original copy Bill of Sale, original mileage statement and away I went with 30days to get my own state tags. The certificate of origin was mailed to me by my dealer within 10 days.I would say this florida dealer needs to feel some real heat and I would use BRP,the BBB ,you local DMV legal Division.

:agree:

I walked away with my bill of sale, certificate of origin, temp tag and everything and I went to the DMV and the only problem I had was that on the Cert. of origin, BRP didn't type in their dealer number on the top line...... it was a pain and I had to make some calls but eventually a supervisor just let it go because everything else was in order....... it took almost 5 hrs at the DMV though........ but I was totally legal when I left...... now just waiting on a vanity plate.... "OMFG" which I got from reading a post on here

BRP is the manufacturer....they don't have or need a "dealer number" The incompetence of the DMV employees is sickening.

Your dealer committed a crime by using the address of one of their employees to register the vehicle in Florida. They could loose their dealer license because of it. It was completely unnecessary as no sales tax is due in FL when a vehicle is purchased by an out of state resident. They pay the tax when it is registered/titled in their home state. I agree the path to follow is what Buelldog recommended. This dealers name should also be posted all over the internet.

Call the dealership back and ask to talk to one of the owners, or a manager. Sounds to me like you gat a bike that was not ordered for you. Dealers will do this to put more bikes on their lot to sell, and can do it this way with out the manufacturer looking into it. If you are really upset, contact Can Am and let Can Am look into it. As much as I love my Spyder, Can Am and some of the dealers have a long way to go to get business respect.

Each state is different, some have reciprocal agreements, and some don't. Thats why you must wade through the Fla and TN MVD rules. I live in AZ and bought in Calif. If the dealer shipped the Spyder to me, then no sales tax and no registration collected in CA... but both have to be paid in AZ upon delivery. If I take take delivery in CA and ride it home, I would have to pay both CA tax and registration... then pay AZ registration when I got home (but not sales tax). I trailered it, so I paid CA tax, but no CA registration... only AZ.
