• There were many reasons for the change of the site software, the biggest was security. The age of the old software also meant no server updates for certain programs. There are many benefits to the new software, one of the biggest is the mobile functionality. Ill fix up some stuff in the coming days, we'll also try to get some of the old addons back or the data imported back into the site like the garage. To create a thread or to reply with a post is basically the same as it was in the prior software. The default style of the site is light colored, but i temporarily added a darker colored style, to change you can find a link at the bottom of the site.

NYS law for transporting merchandise/product in open truck?

I was on my spyder today in 3 lane traffic (one direction) in the middle lane. The stake rack truck ahead of me was carrying product which was higher than the stakes. It was shrink wrapped. Long story short, I saw the shrink wrap break and I hit the brakes as two pieces of product came off the back of the truck and land in front of me and as if Moses was parting the sea one piece went into the lane to my left and the other piece went to the right of me; they were around 3' x 3' x3'.

Is there a law that merchandise has to be tied down or is shrink wrap enough? I felt like calling the police; but, didn't.

The trucker did stop; but, it wasn't because of me.

NOT 100 % on this but I am very very sure every jurisdiction has something similar to Vermont called "unsecured load violation",...nothing , and I mean nothing can fall or be throw off/from a vehicle/truck on a public highway.....Most states also require loads to be covered.....Hope this answers your Question......Mike former LEO.....:thumbup:

Like Blueknight said, states have laws regarding unsecured loads. The USDOT has laws regarding interstate transport. Although shrink wrap was used, the load must still be tied down. Having said that, it's possible all the requirements were met for your state but sometimes things do happen. Glad you escaped without any injuries/damage.
 
It's called depositing a foreign object on a roadway, Which is illegal, And that even covers snow blowing off a vehicle. And even if nothing fell off the Trucker can still be sited for an improperly secured load.!

This is from the Ohio Revised Code (ACTUAL LANGUAGE)

4513.31 Securing loads on vehicles.


(A) No vehicle shall be driven or moved on any highway unless the vehicle is so constructed, loaded, or covered as to prevent any of its load from dropping, sifting, leaking, or otherwise escaping therefrom, except that sand or other substance may be dropped for the purpose of securing traction, or water or other substance may be sprinkled on a roadway in cleaning or maintaining the roadway.
(B) Except for a farm vehicle used to transport agricultural produce or agricultural production materials or a rubbish vehicle in the process of acquiring its load, no vehicle loaded with garbage, swill, cans, bottles, waste paper, ashes, refuse, trash, rubbish, waste, wire, paper, cartons, boxes, glass, solid waste, or any other material of an unsanitary nature that is susceptible to blowing or bouncing from a moving vehicle shall be driven or moved on any highway unless the load is covered with a sufficient cover to prevent the load or any part of the load from spilling onto the highway.
(C) Whoever violates this section shall be punished as provided in section 4513.99 of the Revised Code.

also be cited if litter simply falls or blows
from the vehicle.

Unsecured load


– Ohio Revised Code 4513.31
If you haul anything in a motor vehicle, you
must make sure it stays securely attached to
the vehicle during transit. Failure to do so is
a minor misdemeanor for a first offense, a
fourth-degree misdemeanor upon the second
offense within a year, and a third-degree
misdemeanor for each additional offense.

Just glad your safe, I'm very mindful of of trucks when out riding.

I know this was a semi, but the worst offenders our the weekend DIY guys that are on there way back from lowes or home depot with some massive object improperly strapped to there car.

Yupp just yesterday a webber grill launched it self off the back of a pick up truck missed the 2 wheeler behind it and finally ended up out of the traffic path. No harm lots of foul. Oh yeah and a bunch of sign language if you know what I mean
