• There were many reasons for the change of the site software, the biggest was security. The age of the old software also meant no server updates for certain programs. There are many benefits to the new software, one of the biggest is the mobile functionality. Ill fix up some stuff in the coming days, we'll also try to get some of the old addons back or the data imported back into the site like the garage. To create a thread or to reply with a post is basically the same as it was in the prior software. The default style of the site is light colored, but i temporarily added a darker colored style, to change you can find a link at the bottom of the site.

I removed previous thread since many of us got too political....

So about 2 months ago I got 2 tickets within a week of each other. One was for speeding in Indiana.. 87 in a 70. The other was for rolling a stoplight that was yellowish-pinkish-red-- trying to stay with the group of bikes I was with... being the last one thru the light.... I'm the only one that bothered to pull over for the cop... so I got the ticket.

Just for Bob.... I managed to work the system a bit to my advantage.

Speeding ticket:

1. Filed for a continuance on the court date to have more time to prepare my case.
2. Filed a discovery request (in accordance with Indiana rule 26) to the court for various records: Officers certification and training records for operation of radar device, officers daily log, Radar log, Radar calibration records, tuning fork certification records, etc.
3. Request for information on possible deferral options for the state of Indiana.

Judge called me today and said he was a bit overwhelmed at my requests (which is exactly what I wanted).... and that he wanted to talk about a deferral (which is what I wanted). I played dumb and acted like I wasn't aware of how deferrals worked in Indiana.. let him explain them to me... was very pleasant and we agreed to a deferral. All that is required from me..... 6 months without another ticket...... and.... yup.. you got it.... some extra $$$$$$. No points. Ticket never shows up on record, yada yada.

Traffic ticket:

Went to court with photos of light and various timing sequences, wanted to figure out where the cop was, etc. when he saw it. Ticket stands as I thought it would....... but was offered a deferral when I asked for one. Just have to pay the ticket, take an online safety course, pay some extra $$$ (see a pattern here?) and the points and ticket go buh-bye.

Oh... and Bob..... I pick the judges daughter up tonight at 7:00....... :roflblack:


Sure... it's easier and cheaper not to get tickets in the first place... duh..... but when you do get them.... work the system folks.... you can keep those points off your record.

The speeding one I get....as I like me some SPEED.

The signal ticket was just plain stupid on my part.. and my buddies that I was riding with... none of whom stopped.

I'll be obeying all traffic laws for the next 6 months.. well... I'll keep it under 10 over...... ;)

Here in New York, they've removed "Judge's Discretion" from the toolbox...It caused quite a ruckus when they yanked it, but it seems to be forcing everybody to play on a level field... :thumbup:
Soooo... I wouldn't suggest playing fast and loose on our roads; there's no sense of humor over here! :shocked:
 
Yes... But the District Attourney is at the County level of Government. Town Justices are the ones that handle traffic violations. If you get to sit in the big chair in front of the D.A.; you have really screwed up! :shocked: Whatever tickets you got; they are going to be dismissed so that you can start your jail time...
 
Not true, assistant Da's Go out to the towns. I have already been through the new process.
 
Ulter County DAs must need to "politic" more than they do over here... No Sullivan County Assistant D.A. has ever seen the inside of a Neversink Town Court...
 
For what it's worth, I got a ticket in my car for not stopping at a red light (I was past the limit line, but the cop honestly didn't see that). I paid an attorney $1000, they filed all sorts of discovery, and when it came to the trial yesterday the cop didn't show up. No idea if I just got lucky, or if, as my lawyer suggested, he didn't think it was worth bothering with because I'd hired an attorney who specialized in tickets and related issues, but the case was dismissed. For $1000 to my atty instead of $500 to the courts, I avoided the cost and time of traffic school, and can go to traffic school in the future (the next 18 months) if necessary.

I'm fairly sure my wife would have had an issue if I dated the judge's daughter in this particular instance, but I would be very careful not to let that particular choice backfire on you!
 
That's an option... hoping that the LEO doesn't show up for the trial.
But again; here in New York, if the Trooper doesn't show up they notice that and keep track of it. Too many non-apearances and they get dinged for it.
 
Here in Michigan they now schedule ALL of the tickets for a particular cop so they are all on the same day every month... AND.... the cops often get OVERTIME PAY for showing up to court... so they WILL show up.

Some states now allow the court to file a continuance if the cop doesn't show.. so you just have to show up on another date.....

Yeah-- my local ticket I had to show up to the court and looked at the docket..... had like 20 cases one after another... all the same cop.

The Indiana one I was able to do by remote control... ;-)

From a point of view of fairness, it seems very reasonable to schedule the cop's appearances together. On the other hand, having somebody come back because the cop didn't show isn't very fair to the defendant, especially when we're just talking about an infraction.

It's interesting to see two solutions to the same challenge, one which preserves the rights of the accused and is efficient with the defendant's, the court's and the police officer's time, and the other that does neither of those.

About 2 years ago my wife was driving in TN and got stopped for 15 over. She paid the ticket and thought that was the end of it. 18 months later she received a letter from the NC DMV. They said that she was to surrender her license for 30 days because of the ticket in TN. Since a license in NC is the property of the state of NC, that it is a privilege not a right to have a drivers license, and she abused it, that they have the right to suspend it for 30 days. They said she could contest the suspension, but if she lost, they would suspend the license for 60 days. The law say the law in NC says anything 15 or more over the limit can result in suspension of of license for up to a year NO MATTER WHAT STATE ISSUES THE TICKET. When she asked why they were doing this 18 months after the fact, THEY SAID THEY HAD BEEN BUSY!
