What!! Why is this not street legal or does it depend on your state?
You are going to be seeing a lot more aftermarket exhausts, etc. that will be carrying this disclaimer; "For race use only". "Motorcycle Consumer News" (MCN) had an article about this in their current issue (Volume 39 Number 4) ... by-the-way, I highly recommend this "100% Subscriber Supported" magazine .. (

Back to the article. It said that CARB (The California Air Resources Board) recently fined Dynojet Research, Inc one million dollars since their Power Commander did not meet CARB standards. Dynojet will now have two types of their Commanders: one listed "For Race Use Only" and one that is CARB-compliant which eliminates changes to the ignition and mapping at lowwer rpm which is the area where emissions are normally tested.
As you know, in environmental matters ... how goes California, the rest of the nation eventually catches up!! The writer of the article predicts that all aftermarket suppliers of any product that may or may not effect emissions will ultimately have to match more stringent standards. He further predicted that the next category that will be looked at very hard by CARB will be the aftermarket exhaust manufacturers.
In my own opinion, I think the truth of why Hindle took so long getting their exhaust to market was because of this problem. There is no question in my mind as to why they have labeled their exhaust for closed-course racing only.
Not sure how this will affect Spyder owners in California who purchase the Hindle and then have to get their emission test completed?
In addition to the above, in the same magazine there was also an article about factory warranties; "Reading The Fine Print". Under the heading: "Shades Of Gray" the point was made as follows: "For example, if your bike has a slilp-on pipe, some frame sliders, and you do the occasional track day, any issue that might arise will probably be covered under warranty. If you have a full race exhaust system with Power Comander, safety wiring, and scuffed wheels from lots of tire changes, you may find yourself without warranty support." It is the "gray" area that no conclusion was offered as to what may occur if one has an aftermarket product listed "for race use only" being used for street riding.
It just sounds like to me that due to fear of litigation, the manufacturers of aftermarket products that effect performance that would in turn effect emissions will err on the side of caution in the marketing and labeling of their products.
Perhaps Ken at Evoluzione will chime in on whata all of this may mean to us down the road?
