SE5 Stuck in 1st

I let my uncle drive my spyder yesterday, he drove around, came back, and parked it. About 5 hours later i go outside to start it up and move it back into garage after everyones cars were out of the way.

So i hop on it, and it wont start. I notice its in 1st gear (he parked it and turned the bike off in 1st; i always have done it in nuetral) and i could not downshift it to nuetral. I kept pushing the button and it would not drop. Which led me to my next thought, can you start the spyder in 1st gear? (SE5) So i was walking away to check the manual my buddy got it into first, he said he put his foot on the brake and it dropped down. I just didnt get it, because i had my foot on the brake and tried it, and it didnt work. Any ideas? was i mistaken?

You probably didn't push the brake hard enough to trip the switch.

Yep my dad did the same thing went to another bikers bar to show my Spyder off to his buddies, next thing he's calling me to ask how to start it. I said press the brake, and VROOOM it started.
