• There were many reasons for the change of the site software, the biggest was security. The age of the old software also meant no server updates for certain programs. There are many benefits to the new software, one of the biggest is the mobile functionality. Ill fix up some stuff in the coming days, we'll also try to get some of the old addons back or the data imported back into the site like the garage. To create a thread or to reply with a post is basically the same as it was in the prior software. The default style of the site is light colored, but i temporarily added a darker colored style, to change you can find a link at the bottom of the site.

As the title says I was broadsided by a cage driver in a supermarket

parking lot 5 weeks ago. I am gonna try to tell the story, but will jump

around as things come to mind. The other insurance company has

dropped the ball, so i had to go through mine. The other insurance

company that has a solar planet named after it, is suppose to take

my statement this coming Monday.

It occurred in an uncontrolled

small intersection where his vehicle plowed into the right side with

the main strike occurring on my right rear bag shell. I was traveling

approx. 8-12 mph and am guessing the other vehicle was traveling

the same I didn't see the vehicle until about 12 feet from impact I

remember hitting the horn and seeing the cage passengers face in

shock, as I was catapulted striking my windshield with my full face

helmet and traveling approx 15-20 feet in the air at the eleven o'clock

position, had it been at ten o'clock I could possibly have been seriously

injured, because there is a metal shopping return cart stand full of shopping

carts. I remember in just that instance of impact as to not hold onto the

handle bars of the bike, that people have snapped there wrists doing that.

I believe I learned that in the motorcycle safety course i took 1 1/2 yrs ago.

When I landed, I landed on my backside. I remember the feeling as if it was

yesterday. I distinctly remember the back of my head striking the pavement,

and the cu-sh inside the helmet taking the entire blow ! I stayed on the ground

until the fire department got there. I remember reading a post here where

it was said to not let anyone remove your helmet except medical professionals

. When they got there the LAFD got me upright and checked me out. I had a

bruise on my tailbone but the BRP leather jacket with armor on the elbows a

nd shoulders helped protect me. I had these really cool jeans that had suspenders a

ttached, and the metal sockets ripped out :( I also had real rugged over the

ankle leather boots, and my leather gloves on. The paramedics asked if I

wanted to go to the hospital, and I declined. I could tell that only my tailbone

was hurting and I had no back pain what so ever. Plus I had to work and meet

a client that night and knew that going to emergency would be an all night

ordeal. (believe me if I was injured I would have gone.) My bike when it was

struck was pushed over on it's left side (as the left bag had scrape marks

from the pavement that was not noticed till the next day.)
and then bounced

back and continued on past me striking the second car parked in the row next

to where I lay. My RT put a small dent in that cars bumper and my trunk hood was

all messed up. I asked a bystander if he could shut off my bike by pressing the red

button on the handlebar. When I was laying on the ground waiting for the paramedics

to arrive I text-ed my wife from my cell saying I was OK but if she could

come over just in case my bike was not ride-able. After the Fire dept left the LAPD

showed up but would not take a report since all 3 parties had valid ID and insurance.

There was a security guard who was a witness, but his security firm that is employed

by the supermarket chain won't release info unless subpoenaed.


the repair bill is $8,144 + another $480 for BRP helmet, the mic cord got

messed up, and my clothing which they don't make those jeans anymore :banghead:


My mechanic went over the bike with a fine tooth comb and said that the

bike is sound just a lot of cosmetic damage. My tailbone after about 2

weeks of putting ice on it and then ice/ heat, took just another week of

limping around and being ginger on it. And now I can say I am physically

100% ok!

And I am embarrassed that even though I was not at fault I didn't have

that 6th sense to think about what if ! I can never take for granted that at

any moment I could be struck by a vehicle. Maybe me mentioning this might

help someone who reads it. I was very very lucky.


I am announcing this now even though my bike won't be put back together

for another 10 days or so. I am going to the International motorcycle show

tomorrow, and wanted my fellow spyderlovers to know why I have been absent

from here. Hope to see some spyderlovers there.

Your insurance? I'm pretty sure that even though the police won't get invovled in that enviroment, you can still pursue the other vehicles insurance. Your insurance isn't going after the other vehicle? Parking lot collisions are actually fairly common, I don't know why people think they can use the "parking lot" as a pass since the law enforcement is not involved. You better tell your agen to get his butt in gear.
 
Glad to hear you escaped with minor injuries... these stories are always like a wakeup call to be even more careful about the idiots on the roads. Thanks for sharing the details with us.
 
Things could have been so much worse. Man they make bikes every day!! I wouldn't let his insurance company off the hook so easily.:mad: Pursue, pursue, pursue!!

WOW!!! Thanks for sharing this & Teddy & I BOTH are glad that you are OK. I'm sure your shop will get your Spyder back in tip-top shape. Hope your insurance ordeal gets worked out, that really sounds like a mess :shocked:
 
Glad to hear it wasn't worse. I hope everything gets worked out soon, you heal quickly, and are back on the road real fast. Thanks for letting us know.
 
Sorry to hear about the accident, but glad you are back to tell us about it. The bike can be fixed, and hopefully you will fully recover from your injury.

This is a good argument for ATGATT. One never knows when bad things will happen. It sounds like the gear prevented you from getting hurt worse.

Keep us posted--and yes, pursue the insurance companies for a fair settlement.
 
Myself, along with SRA-SD will see you there TB. Glad you're ok. Sucks the bike is in the 'hospital' though.
 
The fact that you're okay pretty much makes everything else pale in comparison! :thumbup: Don't let the insurance company battles wear you down! If this bonehead is at fault, his company WILL have to payf ro the damages; no matter how many delaying tactics they throw at you.. :gaah:
So fight the good fight and don't back down!

Glad you are OK. Parking lots are often worse than the streets because the ones who pay little attention to their driving on the street,, pay NO attention in parking lots.

Hope it all works out on your Spyder.
 
Over $8000 in damages is a lot. Did you have damage to the front left suspension and wheel? Did the handle bars contact the pavement? Glad you are OK. I think I would have x-rayed my butt bone for possible fracture though. Let us know how the repairs go.
 
My car has also been hit in a parking lot and just like you the police would not complete a report due to it being on private property. My insurance company did go after the other company and about a year later we received another check as settlement. Really surprised me that they took the other company to arbitration to settle the claim.

I just wanted to get the ball rolling with my co., AAA who has been
fantastic. They sent an adjuster out the first week to look
at the bike after the dealership was able to catalog all the
necessary parts to be ordered from BRP, Custom Dynamics
& Kewl Metal and estimate the labor involved. My insurance
company cut them a check that day minus my $1000 deductible.

I was able to ride home after the accident. Two days
later I rode it down to my dealership paying special
attention to the ride feel. To me it was still solid as
before. But I will leave that up to the experts. So they
test rode it , and did a visual inspection They are having
to replace about 50 parts including both fenders, front
bumper Rt wheel kit and windshield. I hope I can still get
the 2010 windshield.(for me I liked it). And I had the
chrome muffler accents that were damaged too. The only
part they are waiting on besides some fasteners are my
handlebar helmet locks from Kewl Metal.

The pain from my tailbone has subsided and what has
set in is depression from not being able to ride. (really) From
hearing from all you and your concern that I am Ok is very
comforting.

ATGATT- I just had to look up the acronym, yeah I was
fortunate to be wearing all what I had on. CA is a helmet
state now. 40 years ago I was on the back of a motorcycle
when a cager made a left hand turn in front of my buddy & I.
That time I was lucky cuz I had no helmet, and only ended up
with a scar just below my shin. That was enough for my parents
to say no motorcycles, and I missed playing football my senior year.

I am re living my teenage years again now ,this spyder experience means so much to me.
