    Default Bike turn in due to lemon??

    I posted in the RT section about the problem with my brakes. The dealership has ordered the new part that BRP told them would fix the issue. It was installed and guess what...no change. Brake failure lights still flashing and warning light coming on.
    They can't seem to figure out what's wrong with the bike and now BRP doesn't know either. It is starting to approach a time where the dealership will have my bike in the shop longer than it's been in my garage.
    What can be done about this? The manager at the dealership told me that there will be no exchange for a new bike.

    If you "push" your Dealer: they should be able to get BRP to send a Tech that knows how to fix this.
    This is a relatively small issue; that should be easy to fix... Good luck!

    In communicating with BRPCare be polite, professional and as detailed as possible. It would be prudent to include a request that BRP send a tech to the dealership to correct the problem as Bob suggests. Unfortunately, if the SC lemon law doesn't include motorcycles the manager is right.

    SC is one of the states that has a Lemon Law. If a problem occurs within the first 12,000 miles and the dealer is given three reasonable chances to fix it and fails, the vehicle falls under the law. The three occurrences do not all have to occur within the first 12K miles, just the first incident.

    According to google SC's Lemon Law does not include motorcycles.

    Probably seen your other post and commented on them. Brake failure can come from several places. Most common is the fluid level, which is very sensative and many see plenty fluid and dismiss it, brake pedal switch sticking or malfunctioning, float level sensor malfunction and of course ryding with your foot on the pedal. If only one dealer and tech has been involved perhaps another would be helpful. Other things are like brake light bulbs, pads sticking calipers causeing brake drag.. Do hope someone your way can find the problem...and

    I just got back to the house and checked my Title 56 SC Law Reference and according to it, Motorcycles are considered Motor Vehicles in SC and are covered under the Lemon Law. Below is a partial copy of Title 56-28-10:

    (4) "Motor vehicle" means:

    (a) a private passenger motor vehicle, as classified by Section 56-3-630, but excluding the living portion of recreational vehicles and off-road vehicles, which is sold and registered in this State; and

    (b) a motorcycle as defined in Section 56-1-10(8), including a motorcycle three-wheel vehicle as defined in Section 56-1-10(18), which is sold and registered in this State.

    All legal loopholes contain at least three subordinate loopholes.

    Was the part the the left handlebar switch? If not it probably needs to be replaced. From what I'm reading here about this problem I suspect a CANbus signal problem caused by either a malfunctioning left switch module or an as of yet unknown gremlin. Remember all the issues with the DESS and limp home errors caused by 2014 RT CBs? Kind of the same thing, some strange external force is mucking up digital signals. BRP may not have an answer yet.

    I think they have to be given ample attempt to fix it....I believe it's 3 attempts at the exact same issue with the exact same results each time before they even consider exchange. It sucks, but don't get your hopes up

    Check with your state laws, here in California we have the (BAR) Bureau of Auto Repair
    and we have a LEMON LAW they enforce. if your vehicle has been in for repairs that cannot
    be resolved among other reasons they must replace the vehicle.

    Just curious. What does the South Carolina DMV register a Spyder as? Here in Nevada it gets registered as a "roadster". Would the SC "motorcycle three-wheel vehicle" include that definition? Is the Spyder registered as a "motorcycle" in SC?

    In SC, Spyders are registered as a motorcycle. Three wheel motorcycles can be driven with just a regular operator's license, just like a car. Two wheel motorcycles require a MC endorsement. There was a time for only one year that SC had a special endorsement for a trike, but they quickly did away with it. No helmet law for motorcycles.

    Update...
    It was the VCM (Vehicle Control Module). They replaced it and all the problems were corrected.
