An ebay user that opens an unpaid item case one day after I offered on their "best offer" item. They didnt even respond in the affirmative, and still opened the case.

Argh.
There must be more to this. The seller has to accept the offer first and then the buyer has time to make payment. I don't think it is even possible to file a 'Non-Paying Bidder' claim within 1 day of purchase. Which you're saying you did not do in the 1st place.
You can always call eBay and get their 'Expert' input on the situation.

Yoy are correct the seller has to wait 2 days after sale to open a case.

I sent the offer on wednesday late at night. Friday, they open a case. I suppose if you consider all day thursday and most of friday, its almost two days.
I have nearly 900 transactions on ebay, I am not a rookie. Thing is, the seller has over 1k feedback, so you would think they would know the rules, too.
I emailed them with my payment, will let yo know if they say anything.

From the listing completed page... from that perspective, same day. Whats up with the unpaid item case? Can I get an amen? note that they ended the listing early on Wednesday, and filed the case at 10 something am today. So its two days, technically. Still unnecessary. If they had communicated and/or followed ebay's best offer process, the unpaid case was unnecessary.

Hi Richard,
Seller partsnj has opened an unpaid item case for Can Am Can-am Spyder Rear Sport Rack Lid Cover. They opened the case because they haven’t received payment for the item.
Please pay by Apr-05-16, so the seller can ship the item to you, otherwise, the seller can cancel this order.
If you already paid for the item, please contact the seller to work it out so the seller can close the case with no repercussions. It’s important that you try to resolve this problem because an unpaid item can be recorded on your account and result in future restrictions to your account.
Pay it by April 5th and the whole thing is pretty much a moot point. Seller has probably been pissed-off by non-paying or really slow buyers and now thinks this is the way to insure the buyer pays in a timely fashion (lame, I know... I usually wait at least a full 7 days and then only send a reminder at that).
So pay it, get your item, and don't buy from that seller again in the future if you like.
